No.168 of 2019 on the file of Principal District Judge, Thiruvallur and transfer the same to the Principal Family Court, Chennai for joint trial with the case filed by petitioner in O.P. COMMON ORDER Wife has filed Transfer Civil Miscellaneous Petition No.1009 of 2019, to withdraw I.D.O.P. No.3720/2019, pending on the file of Principal Judge, Family Court at Chennai and transfer the same to the Principal District Court at Thiruvallur.
2. Husband has filed Transfer Civil Miscellaneous Petition No.35 of 2020, to withdraw the case in I.D.O.P. No.168 of 2019 pending on the file of Principal District Judge, Thiruvallur and transfer the same to the Principal Family Court, Chennai, to be tried along with O.P. No.3720 of 2019, filed by the husband.
3. When the matters are taken up for hearing, it is represented by both the learned counsel for the parties, that the parties have no objection for the matter being heard at Chennai and that a speedy trial alone may be ordered in order to give a quietus to the matter.
4. Taking note of the submission made by both the parties, I.D.O.P. No.168 of 2019 pending on the file of Principal District Judge, Thiruvallur is withdrawn and transferred to Principal Family Court, Chennai, to be tried along with O.P. No.3720 of 2019. No orders are required to be passed in Tr.C.M.P. No.1019 of 2019, as the parties have agreed to contest the matter at Chennai. The learned Judge of the Principal Family Court, Chennai, is expected to conclude the trial, as expeditiously as possible, without adjourning the matter beyond 45 working days, at any point of time, in order to bring the issue to a logical end.
5. The Transfer Civil Miscellaneous Petition No.35 of 2020 is allowed and the Transfer Civil Miscellaneous Petition No.1009 of 2019 is dismissed. No costs. Consequently, the connected Civil Miscellaneous Petitions are closed.
