In a proposed suit for recovery of money, jointly or severally, from the two defendants, the intending plaintiff seeks leave to sue the first defendant before this Court.

2. Learned counsel for the plaintiff submits that the cause of action in the suit arose within the jurisdiction of this Court when the first defendant, who was the former accounts officer of the plaintiff, had fraudulently processed payments under 'letter order' and advanced money to the second defendant.

3. Upon examining the draft plaint and on considering the above submissions, it is clear that at least a part of the cause of action arose within the jurisdiction of this Court. Therefore, A.No.824 of 2023 is allowed by granting leave to the applicant to sue the first respondent before this Court.

4. As a corollary, the Registry is directed to number the suit, if otherwise in order.
