This application is filed to set aside the ex-parte order dated 18.11.2019.

2. I heard the learned counsel for the applicant/defendant and the learned counsel for the respondent/plaintiff.

3. The learned counsel for the applicant submitted that there was a delay in filing the written statement and that therefore, the order dated 18.11.2019 was passed setting the applicant ex-parte.

4. The learned counsel for the respondent has no objection, if this application is allowed.

5. Upon considering the submissions of the respective parties and on examining the affidavit in support of the application, I am of the view that the applicant has made out a case to set aside the ex 1/2 http://www.judis.nic.in

A.No.9569 of 2019 in C.S.No.2 of 2019 parte order dated 18.11.2019.

6. Accordingly, this application is allowed and the order dated 18.11.2019, is hereby set aside.
