ORDER
This petition has been filed to quash the proceedings in PRC No.11/2025 on the file Judicial Magistrate, Katpadi.
2. It is the case of the prosecution that the petitioners/A3 & A4 and other accused while taking river sand, the defacto complainant objected the same and captured their act in his cell phone. The petitioners got angry and broke his cellphone and A1 and A2 cut the defacto complainant's head with a knife.
3. The learned counsel for the petitioner submitted that the petitioners are the sons of Munisamy/A1. There is an allegation against A1 that he caused cut injury on the head of the defacto complainant and at that point of time, the petitioners were present and hence, they were impleaded in this case. He further submitted that no case is made out as against the petitioners.
4. The materials indicate that they have been implicated since they are the sons of A1. All these facts shall be taken note of by the Trial Court while
framing charges and while appreciating evidence. However, taking note of the injury caused by A1 and others, final report cannot be quashed partially.
5. Considering the above, I do not find any merit in this petition to quash the final report. Accordingly, this petition is dismissed. However, the appearance of the petitioners before the Trial Court is dispensed with. 15-09-2025 pvs Index:Yes/No Speaking/Non-speaking order Internet:Yes
