O R D E R
The petitioner, who was arrested and remanded to judicial custody on 21.10.2024 for the alleged offence under Section 8(c) r/w 20(b)(ii)(B) of NDPSAct in C.C.No.916 of 2024 in Cr.No. 25 of 2024 pending on the file of the learned Principal Special Court under EC & NDPS Act, Chennai. seeks bail.
2. The allegations against the petitioner is that the petitioner was found in possession of 2.150 kgs of ganja. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that originally, the petitioner was released on bail on 15.03.2024 in Crl.MP.No.2622 of 2024, but failed to comply with the conditions as imposed by the Court. Hence, the respondent police has filed cancellation of bail petition and same was allowed by this Court vide order dated 22.08.2024 in Crl.OP.No.18231 of 2024 and thereafter he was remanded to judicial custody 21.10.2024. He further submitted that the petitioner has been in judicial custody from 21.10.2024 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for 2/5
the respondent police reiterated the prosecution case and reported that the banned contraband was seized from the accused and the petitioner is having 12 previous cases including three murder case, one under NDPS Act, one case under Arms Act and one case under 109 of BNS Act. He further submitted that final report filed and the same has been taken cognizance in C.C.No.916 of 2024. Hence, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record.

Taking into consideration the facts and circumstances of the case and the submissions made by the learned counsel on either side, the gravity of offence committed by the petitioner and also taking note of the fact that the banned contraband was seized which is an intermediate quantity and there are 12 previous cases are pending as against the petitioner and the bad antecedents, this Court is not inclined to grant anticipatory bail to the petitioner.
