Crime No.314 of 2023 Respondent(s) PRAYER This Criminal Original Petition has been filed under Section 528 of BNSS, seeking to modify the condition of the Learned V Additional District and Sessions Judge, Coimbatore order made in Crl.MP.No.5012 of 2025 vide order dated 25.09.2024 "the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- with two sureties each for a like sum to the satisfaction of this court and out of the two sureties one surety should be blood relation of the petitioner accused".

ORDER

This Criminal Original Petition has been filed to modify the condition imposed by the learned V Additional District and Sessions Judge, Coimbatore in Crl.M.P.No.5012/2024 dated 25.09.2024.

2. The learned counsel for the petitioner submitted that the petitioner is an innocent person and the Lower Court while granting bail to the petitioner in Crl.M.P.No.5012/2024 dated 25.09.2024, directed him to execute one blood surety. However the parents of the petitioner are no more and his relatives are refusing to stand as a surety. Hence, the modification petition has been filed by the petitioner.

3. Heard the learned Government Advocate (Criminal Side) appearing for the respondent police.

4. Considering the facts and circumstances of the case and finding that the reason is justifiable, this Court is inclined to modify the condition in respect of

blood surety. Accordingly, the condition in para No.5 (ii) is removed and that the petitioner/A1 is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- with two sureties each for a like sum". The other conditions imposed by the Court shall remain intact.

5. With the above modification, this Criminal Original Petition is ordered.
