The petitioner is an accused in Crime No.564 of 2023 registered for the offences under Sections 7 and 8 of POCSO Act, 2012 seeks bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal side).

3.The learned counsel for the petitioner stated that there was an ongoing dispute between the family members of the petitioner and family members of the defacto complainant and therefore, a false complaint has been given.

4.But however, statement had been recorded under Section 164(5) Cr.P.C of the victim child and as a matter of fact, she expressed shock when the petitioner misbehaved with her, though she termed the petitioner as brother. C.V.KARTHIKEYAN , J.

Crl.O.P.No.26856 of 2023 5.Let a final report be filed and the victim child be examined as witness in the trial Court. In view of the facts and circumstances, at this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
