A.No.9414 of 2019 A.No.9414 of 2019 SENTHILKUMAR RAMAMOORTHY, J This application is filed for leave to institute the suit against the defendants in respect of plaint 'C' schedule property which is situated outside the jurisdiction of this Court.

2. I heard the learned counsel for the applicant.

3. The learned counsel for the applicant submitted that the applicants are the owners of both "B" and "C" schedule property and that the defendants misused their fiduciary relationship with the plaintiffs in order to usurp the said properties. He further submitted that the 'B' schedule property is situated within the jurisdiction of this Court and that all the defendants reside within the jurisdiction of this Court. Consequently, he submitted that it is just and necessary that leave should be granted as regards 'C' schedule property.

5. On perusal of the above, it is clear that all the defendants reside within the jurisdiction of this Court and Schedule "B" property is also within the jurisdiction of this Court. Moreover, the cause of action has also arisen within the jurisdiction of this Court.
