By this application, defendants 3 to 10 seek permission to file the eleven documents listed in the Judge's summons. 2.Learned counsel for the applicants submits that these documents were relied upon when the interlocutory applications were contested. Kj that only photo copies thereof are available. Therefore, he seeks leave to rely on secondary evidence.

3.A counter affidavit has been filed on behalf of respondents 1 to 4. The objection raised therein is that these are photo copies. It is further stated by learned counsel that if these documents are permitted to be filed, it should be subject to the respondents' objections with regard to admissibility, relevance and proof.

4.Upon considering the reasons set out in the affidavit for adducing secondary evidence and being satisfied that sufficient cause is shown, this application is allowed subject to the right of the respondents to raise objections inter alia on the grounds of admissibility, relevance and proof in course of trial.
