PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 herein to take action against the 5th respondent herein for putting up illegal constructions in the lands measuring 0.18 cents in S.F.No.132/3 at Kaivilancheri Village,

O R D E R

This writ petition has been filed, to issue a Writ of Mandamus, directing the respondents 1 to 4 herein to take action against the 5th respondent herein for putting up illegal constructions in the lands measuring 0.18 cents in S.F.No.132/3 situate at Kaivilancheri Village, Sirkazhi Taluk, Mayiladuthurai District belonging to A/M.Sabanayagar Temple, Chidambaram and to evict him from therewith within a stipulated period.

2. The learned counsel for the petitioner would submit that the 5th respondent herein is illegally constructing a commercial complex in the lands belonging to the temple, without any approval from the temple authorities. Therefore, the petitioner made several representation to the respondents 1 to 4. However, no order was passed by them. Hence, the present writ petition is filed with the above said prayer.

3. Since no adverse order was passed against the 5th respondent, notice to the 5th respondent is dispensed with.

4. The learned Government Advocate appearing for the respondents 1 to 4 would submit that they will consider the petitioner's representation in the manner known to law.

5. In view of the above, this Court is inclined to issue a direction to the 3rd respondent to consider the petitioner's representation, after affording an opportunity of personal hearing to the parties concerned and pass orders within a period of four (4) weeks from the date of receipt of a copy of this order.
