The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 420, 409, 506(i), 120(B) and 34 of IPC in Crime No.232 of 2023, seeks anticipatory bail.

2.Let me not enter into a detailed discussion on the facts, but record the statement of the learned Government Advocate (Criminal Side) for the respondent, that as on date, 11.12.2023, the petitioner is not an accused in Crime No.232 of 2023. However, the further statement of the learned Government Advocate (Criminal Side) is also recorded that the mobile phone of the petitioner had been seized and had been returned back.

3.But, further investigation will have to be done and if during the course of investigation it emanates that the petitioner was also involved in the offences alleged, then they will have every right to array him as an accused.

smv 4.At this stage, this Criminal Original Petition stands dismissed. Consequently, connected Miscellaneous Petition stands closed. If need arises, the petitioner is always at liberty to file a fresh petition.
