PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, forbearing the respondents from infringing the petitioners right to travel abroad with his wife by withdrawing or suspending the petitioners Look out Circular issued at the Instance of 4th respondent against the petitioner.

ORDER
The petitioner seeks to suspend the look out notice issued against the petitioner.
2. Though the petitioner is not arrayed as accused in the FIR, but, he was arrayed as A52. The allegations against the petitioner is that the petitioner has helped the other accused in admitting the students in NRI quota, thereby, committed the offences under Sections 336(2), 336(3), 337, 340(2), 318(4) read with 62 of BNS on the file of the respondent police. The petitioner seeks to challenge the look out circular only to visit Switzerland by accompanying her wife who is undertaking higher education. It is the contention of the petitioner that the look out notice be suspended only for accompanying her wife in order to get admission in the college and returning back only 25.09.2025. The tickets in this regard is also filed before
this Court.
3. Considering the nature of the charges, let the petitioner give an affidavit before the police by today itself indicating the particulars where he resides in Switzerland, his contact number and date of return etc., and also considering the fact that the petitioner's family resides here, the respondent shall keep the look out notice suspended till 30.09.2025. The learned Additional Public Prosecutor is directed to give instructions to the concerned police authorities to give necessary instructions to the Immigrant Authority as the petitioner is flying tonight.
