ORDER
The petitioner/A18 in C.C.No.554 of 2023 had filed a petition before the trial Court in Crl.M.P.No.11520 of 2025, seeking to travel to England for 1/6
his son's treatment from 16.09.2025 to 25.09.2025. The trial Court, by the order dated 28.08.2025, permitted the petitioner to travel to England. While granting permission to the petitioner to travel to England, a typographical error occurred in the order. Instead of United Kingdom it was typed as Ireland. It is seen that cut and paste method adopted in the earlier order passed on 28.08.2025. Hence, the petitioner filed a modification petition in Crl.M.P.No.12301 of 2025 before the trial Court. The trial Court, by the order dated 04.09.2025, passed the impugned order with certain conditions. 2.The learned Senior Counsel for the petitioner submitted that earlier the petitioner approached the trial Court during November, 2024 seeking permission to travel to Ireland. The trial Court in Crl.M.P.No.59180 of 2024, by the order dated 07.11.
2024 granted permission to the petitioner to travel to Ireland. Thereafter the petitioner filed Crl.O.P.No.28577 of 2024 before this Court seeking modification of the conditions (g), (h) and (j) of the order in Crl.M.P.No.59180 of 2024 and this Court, by the order dated 27.11.
aside the conditions permitting the petitioner to take his travel to Ireland. The petitioner completed his travel, came back to India and was appearing before the trial Court. Thereafter for the petitioner's son's medical treatment, again he filed a petition before the trial Court in Crl.M.P.No.11520 of 2025 seeking to travel to England. In this petition also similar conditions, which were set aside by this Court earlier has been imposed. Hence, a modification petition in Crl.M.P.No.12301 of 2025 filed and the same was partly allowed with regard to the conditions (a), (c), (f) and (g) and the last paragraph in the order in Crl.M.P.No.11520 of 2025 dated 28.08.2025 only to the extent of Country Name, i.e., United Kingdom instead of Ireland. The present petition is filed by the petitioner seeking to set aside the conditions imposed in Condition Nos.(g), (h), (i) and (j) in Crl.M.P.No.12301 of 2025 with change of dates for his travel permission, i.e., 15 days travel to England in the month of October, 2025.

3.The learned Special Public Prosecutor appearing for the respondent fairly submitted that the conditions (g), (h), (i) and (j), which was imposed presently, has been earlier set aside by this Court in Crl.O.P.No.28577 of 2024. He further submitted that the petitioner is appointed as Non Executive Chairman in Tourism Development Finance Corporation of India. The petitioner now requires to visit England for his son's medical treatment. The only apprehension of CBI is that the petitioner to participate in the trial, citing his absence he should not cause any delay to the trial proceedings. 4.The learned Senior Counsel for the petitioner submits that the petitioner will not be a cause for any delay and he will return back once the purpose of visit to England is over.
5.In view of the above, this Court set asides the order dated 04.09.2025 passed in Crl.M.P.No.12301 of 2025 insofar as the conditions (g), (h), (i) and (j) alone. The conditions (a) to (f) will remain the same except for the 4/6
modification in condition (a) that the petitioner is permitted to travel to England for a period of 15 days during the month of October, 2025. The petitioner's exact date of travel should be submitted to the Court as well as to the respondent by way of a Memo along with the copy of his travel documents.
6.With the above directions, the Criminal Original Petition is disposed of.
