Saroja Ammal @ Sarojini v. Kuppammal And 26 Others
A.Nos.6264 & 6265 of 2023 in O.P.No.371 of 2023 N.SATHISH KUMAR, J.
These applications have been filed to condone the delay of 2343 days in filing an application to set aside the abatement caused due to the death of the 8th respondent and to set aside the Order of abatement passed against the 8th respondent in the Original Petition.
2. It is the contention of the learned counsel appearing for the applicant that only at the time of filing the Original Petition for grant of Letters of Administration of the Will of one Pattammal, he came to know about the death of the 8th respondent. Hence, the present applications have been filed.
3. The Original Petition has been filed in the year 2022 for grant of Letters of Administration. In such view of the matter, when there is no Order of abatement, condoning of the delay in filing an application to set aside the abatement and setting aside the abatement will not arise.
4. Accordingly, these applications are closed.
