Respondent(s) PRAYER This Writ Petition has been filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the 5th respondent/police department to give police protection to the petitioner for opening the Shop No.311 for smooth running of the TASMAC shop at No.1, PVR Complex, Amaindha Kadappa Road, Santhosh Nagar, Chennai-600 099, in S.F.No.78/2, Puthagaram Village, Madhavaram Taluk, Thiruvallur District. ORDER

This writ petition has been filed seeking issuance of a writ of mandamus directing the 5 th respondent to give police protection for opening the TASMAC shop.

2. The case of the petitioner is that he has entered into a rental agreement dated 21.05.2025 with the landlord, M.Selvam, for the purpose of running a TASMAC shop, bar and restaurant on a monthly rent of Rs.50,000/-. He has also paid a sum of Rs.5,00,000/- as advance. However, due to the agitation of the local residents, there is a threat in opening the TASMAC shop, and hence, he is unable to run the business and seeks police protection.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (crl.side) appearing for the respondents.

4. At the out set, this Court is of the view that the petitioner, being a third party, is not entitled to seek such protection. If at all there is any threat by the outsiders in connection with opening the shop, it is for the TASMAC corporation to approach the Court, and not a third party.

5.
