ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.05.2025 for the alleged offence under Section 8(c), 20(b)(ii)(C) of NDPS Act in Crime No.30 of 2025 on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner is ranked as A2 and on his instructions, A1 purchased ganja, total quantity of 22 kgs from other state. While transporting the same, A1 caught red handed and during investigation it revealed that the petitioner handed over ganja to A1 at East Tambaram Railway Station, which was brought from Anakapalle by train. Hence the case.

3. The learned counsel for the petitioner submitted that there is no recovery was effected from this petitioner and he has been falsely implicated in this case. He further submitted that he is willing to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that though there is no recovery from this petitioner there are materials available to connect the petitioner herein with the arrested A1 and investigation is not concluded. He further submitted that 13 previous cases has been registered against this petitioner out of which, three cases are similar in nature. Hence, he opposed to grant bail to the petitioner.

Considering the nature of allegation and also his previous bad antecedents and gravity of offence also the fact that the investigation is not concluded, granting bail at this stage, result in possibility of tampering the evidence. Hence, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 14.10.2025 ssi To:
