A.No.388 of 2023 A.No.388 of 2023 in O.P.No.69 of 2022 SENTHILKUMAR RAMAMOORTHY,J By this application, the petitioner seeks permission to adduce evidence through her agent.

2. In the affidavit in support of this application, it is stated that a power of attorney was executed on 03.06.2022 in favour of Mr.Bajranglal Damani empowering him to adduce evidence on behalf of the petitioner. Learned counsel for the petitioner states that the petitioner is about 71 years old and not in a fit condition to adduce evidence. On perusal of the power of attorney, it is clear that the agent is empowered thereunder to adduce evidence on behalf of the petitioner.

3. On instructions, learned counsel for the respondent submits that the respondent has no objection to this application being allowed.

4. Upon examining the affidavit and material documents, this application is allowed as prayed for.
