Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the first respondent vide proceedings No.Service2[1]/36776-3/2018 dated 05.03.2019 and to quash the same and consequently direct the respondents to include the petitioner's name for promotion to the post of Deputy Collector in the panel to be drawn for the year 2020. ORDER
This writ petition has been filed challenging the charge memo issued by the 1st respondent dated 05.03.2019 and for a consequential direction to the respondents to include the name of the petitioner for promotion to the post of Deputy Collector in the panel that is going to be drawn for the year 2020. 2.It is seen from records that the petitioner had joined the Revenue Department as a Junior Assistant and thereafter, he was promoted to the post of Assistant in the year 1997. The petitioner has also got further promotion to the post of Deputy Tahsildar and thereafter Tahsildar.
3.On 05.03.2019, a charge memo came to be issued to the petitioner by the 1st respondent on the allegations of irregularity in disbursement of amounts. The petitioner had also given an explanation for the charges levelled against him in May https://hcservices.ecourts.gov.in/hcservices/
2019. Since there has been absolutely no progress in the departmental proceedings, the present writ petition has been filed seeking for appropriate directions.
4.Heard Mr.S.Vijayakumar, learned counsel appearing on behalf of the petitioner and Mr.P.S.Sivashanmugasundaram, learned Special Government Pleader appearing on behalf of the respondents.
5.Taking into consideration the facts and circumstances of the case and also of the fact that the petitioner had already given his explanation for the charge, this Court deems it fit to fix a time limit for completion of the disciplinary proceedings. This Court is not inclined to go into the merits of the case that have been raised in the writ petition and this Court does not want to interfere with the charge memo at this stage. 6.In view of the above, there shall be a direction to the 1st respondent to complete the disciplinary proceedings against the petitioner, strictly within a period of six weeks from the date of receipt of copy of this order.
7.This writ petition is disposed of with the above direction. Consequently, connected miscellaneous petitions are closed. No Costs.
