Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus to call for the records of the Circular No.0482/CASR/R.3/2017, dated 08.02.2017 and the interview call letter dated 20.07.2017 issued by the respondent only to a few selected candidates and quash the same in respect of the petitioner and consequently direct the respondent to select and appoint the petitioner to the post of Associate Professor with effect from 2013 within a time frame to be fixed by this Hon'ble Court. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent and also perused the materials available on record.
2.This Writ Petition has been filed seeking a direction to the respondent, who appoint the petitioner to the post of Assistant Professor with effect from 2013.
3.During the course of hearing, the learned counsel appearing for the respondent has produced a copy of the order dated 04.04.2022 in W.P.No.16333 of 2013 passed by this Court.
4. On perusal of the same, it appears that the petitioner herein filed the above said writ petition. It is mentioned in the said order that the petitioner has been appointed as an Assistant Professor in Tamil Nadu Veterinary and Animal Sciences University. In view of the fact of appointment of the petitioner as the Assistant Professor, the said writ 2/5
petition was closed. However, considering the claim of the petitioner therein for retrospective notional appointment, liberty is granted to the petitioner to make a representation to the respondent and on receipt of the same, the respondent is directed to consider it on its own merits and pass appropriate orders in accordance with law, within a period of 3 months, from the date of receipt of a copy of that order.
5. In the present writ petition also, the petitioner is seeking appointment as Associate Professor.
6. The learned counsel appearing for the petitioner submits that in the light of the order in W.P.No.16333 of 2013, the petitioner made a representation to the respondent seeking retrospective notional appointment.
7. Under these circumstances, in the considered view of this Court, it is appropriate to dispose of the Writ Petition with a direction to the respondent to dispose of the representation submitted by the petitioner as directed by this Court in its order dated 04.04.2022 in W.P.No.16333 of 3/5
2013.
8. Accordingly, this Writ Petition is disposed of.
9. Consequently, connected Miscellaneous Petition is closed.
10. There shall be no order as to costs.
