ORDER
The petitioner, who was arrested and remanded to judicial custody on 26.07.2025, for the offences punishable under Sections 7(a) of Prevention of Corruption Act, 1988 in Crime No.15/2025/AC/CB on the file of the respondent police, seeks bail.
2. The case of the prosecution is that as per the defacto complainant is that petitioner, who is working as Office Assistant under Tahsildar/A1, who is alleged to have asked bribe amount of Rs.50,000/- from the defacto complainant for issuance of solvency certificate. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence, however, he is suffering incarceration from 26.07.2025. He further
submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Crl.side) appearing for the respondent police submitted that A1 demanded a bribe amount of Rs.50,000/- from the defacto complainant. Hence, a complaint has been lodged and the respondent
5. Considering the period of incarceration undergone by the petitioner and also the fact that the investigation has been completed. Further, first accused was arrested and released on bail. Hence, this Court is inclined to grant bail to the petitioner with the conditions.
6. Accordingly, the petitioner is ordered to be released on bail on executing separate bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, in which one surety must be a blood surety for a like sum to the satisfaction of the Principal District and Sessions Judge, Coimbatore, and on further conditions that::
(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure
their identity;
(b) the petitioner shall report before the respondent police on alternative days at 10.30 a.m. for the period of three months. Further, the petitioner shall deposit a sum of Rs. 20,000/- to the credit of the Madras High Court Advocate Clerks Association, Chennai, within a period of two weeks. (c) the petitioner shall not tamper with evidence or witness either during investigation or trial;
(d) the petitioner shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
