This application is filed for permission to file the reply to the written statement.

2. I heard the learned counsel for the applicant and the learned counsel for the respondent/defendant.

3. The learned counsel for the applicant submitted that it became necessary to file reply to the written statement so as to deal with certain averments in the written statement. Therefore, he submitted that this application is filed.

4. In response, the learned Senior Counsel for the respondent submits that the application has been filed belatedly i.e. beyond the time limit of 30 days. Therefore, he submits that this application is liable to be dismissed.

5. Upon considering the submissions of the learned counsel and on examining the affidavit in support of this application, I am of the view that the applicant has made out the case to allow this application by granting the permission requested for. Accordingly, the present application is allowed.

6. As regards O.A.No.26 of 2019, the learned Senior Counsel for the respondent submits that his undertaking is confined to not proceeding with the construction activities without obtaining necessary permission or consent from the Governmental authorities. On the other hand, he submitted that this order is being misinterpreted so as to prevent the processing of the planning permission.
