Order dated 08.06.2023 This Writ Miscellaneous Petition is filed to direct the Respondent No.4 to transfer the cases related to the recovery of elephant tusks in the State of Tamil Nadu which are published as news article in Dinamalar dated 21.08.2021; The Times of India dated 03.09.2021; Times New Express dated 06.02.2022; Deccan Herald dated 09.03.2022; Daily Thanthi dated 12.03.2022; News18 dated 14.09.2022; The Times of India dated 30.10.2022; and National Herald dated 17.10.2022; Dinakaran dated 13.12.2022; Dinamalar dated 15.12.2022 to the Special Investigation Team which was constituted by this Court in WP(MD) No.19771 of 2018 vide order dated 27.04.2022 for further investigation in accordance with law within the time stipulated.
2. In this regard, a status report is filed on behalf of the SIT. It is submitted that as per the earlier orders of this Court, a meeting was conducted and these cases mentioned in the W.M.P. were taken up for Page 1 / 4
discussion and it was found that in respect of the said 9 cases, for 4 cases already final report has been filed and only 5 cases are pending investigation. After scrutinising the papers in respect of the 5 cases, the investigation in respect of WLOR.1/2022 dated 15.10.2022 of Gudalur Forest Division and WLOR .13/2022 dated 13.12.2022 of Vellore Forest Division has already been taken up by the Special Investigation Team. This apart, already Shri.Raj Mohan, DCF has been requested to co-ordinate with PCCF and CWLF of Tamil Nadu to collect details of cases, if any, for investigation. Under these circumstances, the Status Report filed by the SIT is taken on record and no further Orders is necessary in this Writ Miscellaneous Petition, as cases which are fit to be investigated by the SIT has already been taken up by the SIT.
3. This apart two vehicles with sufficient fuel and dedicated driver are required by the SIT so as to continue the investigation. Since the SIT is constituted by this Court, the Government of Tamil Nadu is directed to provide the barest minimum infrastructure which is required by the SIT, considering the fact that SIT has to travel all over the State in order to investigate the cases and discharge its duties. 4. With the above observation and direction this Writ Miscellaneous Petition is closed. No costs.
