The grievance of the petitioner is that, case of the year 2018 not taken up for trial even after lapse of five years.

2. The case pending status of the learned Judicial Magistrate, Avinashi indicates that, the cases are taken up chronologically. Presently calender cases of the year 2017 is getting disposed of. As far as this case is concerned, the matter is pending. Till date, the examination of witness not commenced. The trial Court has adjourned the case to 18.12.2023 for examination of List of Witnesses.

3. In the light of the above, this Criminal Original Petition is disposed of with a direction to the respondent police to marshal the witnesses as per the schedule of the trial Court. To start with, on the next hearing date, respondent police shall ensure that, LW1 to LW3 are served with summons and present before the Court for their examination.
