Today, when this matter was taken up for hearing, a copy of the communication of the Tahsildar, Pollachi, in Na.Ka.No.1836/2023/M1 dated 22.07.2023 and also a copy of the proceedings of the District Collector, Coimbatore in Na.Ka.No.2792/2022fh6 of even date, were produced before this Court.

According to the official respondents, there are 31 persons who had encroached the streets and who are admittedly poor and they do not have any land and that it has been decided to issue alternative sites to them and remove the encroachments. Though 12 weeks' time has been sought to complete the exericise, since this matter is in seizin before this Court for over five years and since patta also has already been issued to 31 encroachers, the encroachments are expected to be removed by the official respondents within a period of 30 days from the date of receipt of a copy of this order and the encroachers are permitted to avail of the alternative sites for which patta has already been issued, as stated supra. Needless to state, police protection shall be provided for removal of encroachments.

It is made clear that within two days from the date of receipt of a copy of this order, if their belongings are not removed by the encroachers, it is open to the official respondents to remove the same and if any damage is caused to the belongings of the encroachers, the official respondents will not be held responsible for the same. Post for reporting compliance on 28.08.2023.
