ORDER

This writ petition has been filed by the petitioner seeking to direct the respondents to issue online patta by considering petitioner's representation dated 13.06.2025.

2.Mr.P.Ganesan, learned Government Advocate, takes notice on behalf of the respondents. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

3.Learned counsel for the petitioner would submit that the petitioner's brother was the original recipient of a Free Natham Patta for the property comprised in Survey No.69/23, vide Manual Patta No.126, Kundrathur Taluk, Chengalpattu District. After the death of the petitioner's brother, the petitioner as

a sole surviving legal heir applied for transfer of patta in his name for the aforesaid property. Upon verification of all documents, the Zonal Deputy Tahsildar issued a manual patta No.126, in the petitioner's name on 19.06.2023. On 17.04.2025, the petitioner applied for online patta for the very same th respondent rejected the same. Therefore, the property. However, the 4 petitioner made a representation before the respondents 1 to 4, for issuance of online patta in his name. However, till date the representation of the petitioner was not considered. Hence, the present writ petition has been filed. 4.Learned Government Advocate appearing for the respondents would submit that since there was no sale deed executed between the petitioner and his brother and the petitioner claim himself as the one of the surviving legal heirs of his deceased brother, the respondents suspect that fraud might has been committed in the present case and rejected the petitioner's application for grant of patta.

5.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the respondents. 6.Considering the submission made by either parties, this Court is of the view that the respondents 2 to 4 have already issued manual patta in the name of the petitioner for the subject property on 19.06.2023. When such being the case, the application dated 17.04.2025 was made by the petitioner only for the issuance of online patta. When the respondents 2 to 4 have already issued manual patta in the petitioner's name for the subject property by verifying the documents, now rejecting the application for issuance of online patta is not sustainable and if any fraud has been committed, the affected person has to raise the complaint and the respondents are no way prevent from issuing online/computerzied patta, when the manual patta has already been granted by them.

7.In view of the above, the respondents are directed consider the representation of the petitioner dated 13.06.2025 and issue the

online/computerized patta within a period of two weeks from the date of receipt of a copy of this order.
