Petitioner Vs.

1. The Registrar, DRT Coimbatore.

2. Sowkar Textiles 25-C, S.N.R Layout New Siddhapudur Coimbatore.

..

Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 1st Respondent to dispose of O.A.No.11 of 2013 filed under section 19 of Recovery of Debts and Bankruptcy Act by the petitioner bank within a time frame as fixed by this Hon'ble Court.

For Petitioner :

Mr.M.L.Ganesh

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The bank has filed this petition with a limited prayer for a direction for expeditious disposal of the recovery application pending before the Debts Recovery Tribunal, Coimbatore.

2. The constitution of Debts Recovery Tribunal was intended to expedite the process of recovery of debts of the bank. It is unfortunate that even after 12 years, the cases have remained pending without any final decision.

3. We do not know as to how may cases filed earlier in point of time have remained pending before the Debts Recovery Tribunal, Coimbatore. However, it would be in the fitness of things that the Debts Recovery Tribunal expeditiously disposes of old matters, including application filed by the bank, without granting

unnecessary adjournment to any other parties.

4. Petition is disposed of. There shall be no order as to costs. (MANINDRA MOHAN SHRIVASTAVA, CJ) (G.ARUL MURUGAN,J) 07.10.2025 Index :
