P.VELMURUGAN, J Today, this petition is listed under the caption ''for being mentioned'' at the instance of the learned counsel for the petitioner.
2. It is represented by the learned counsel for the petitioner that, since the first respondent-wife is a woman of means, she is not entitled for any maintenance and hence, this Court, vide order dated 10.03.2025, modified the impugned order and directed the petitioner-husband to deposit the entire arrears of maintenance still if any, less the amount if any already deposited. However, in paragraph No.9 of the order dated 10.03.2025, it was not specifically mentioned that respondents 2 and 3 - minor daughter and minor son only are entitled for maintenance amount, except the first respondent-wife.
3. In the light of the above submission, entire paragraph No.9 of the order dated 10.03.2025 shall stand deleted and the same be replaced as under:
"9. However, now the revision petitioner/husband Page Nos.1/4
is directed to deposit the entire arrears of maintenance, still, if any, less the amount if any already deposited, only in respect of children, being the respondents 2 and 3 herein, excepting first respondent-wife. The impugned order dated 18.08.2022 made in M.C.No.456 of 2018 on the file of the III Additional Principal Family Court at Chennai, shall stand modified to the effect that the III Additional Family Judge, Chennai, is directed to dispose of the said maintenance case itself, at the earliest, after giving sufficient opportunities of hearing to both parties, on merits and in accordance with law."
4. Further, in the cause title portion of the said order dated 10.03.2025, the representation of the minors by their mother and natural guardian Mrs.Mala Jayashree, had not been indicated. Hence, the Registry is directed to show in the cause title portion that, "respondents 2 and 3 are minor children, represented by their mother and natural guardian Mrs.Mala Jayashree"
5. The Registry is directed to replace paragraph 9 now extracted above, by deleting the earlier paragraph 9, and also to show in the cause title portion of the order dated 10.03.2025, that the minors are being Page Nos.2/4
represented by their mother and natural guardian.
6. Registry is directed to issue fresh order copy forthwith to all concerned.
7. In other respects, the earlier order dated 10.03.2025 shall remain unaltered.
