The present Writ Petition has been filed challenging the impugned order dated 21.11.2022 passed by the second respondent.
2. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that he is a registered medical practitioner and he completed his MRCPCH examination from the Royal College of Paediatrics and Child Health, United Kingdom. He would further submit that he completed his UG Medical Course at the Tamil Nadu Dr. M.G.R. Medical University in April 1999. It is the specific submission of the learned counsel that subsequently the petitioner obtained a certificate of MRCPCH degree from the Royal College of Paediatrics and 2/6
Child Health on 1st December 2019, and when he approached the second respondent for registration of the certificate, they rejected such registration on the ground that the pattern of the MRCPCH exam and the evaluator of the examination are not recognized by the Medical Council of India. Therefore, such a degree cannot be registered under the second respondent. 3.1 It is the further submission of the learned counsel for the petitioner that the reason given by the second respondent, that the MRCPCH degree is not recognized by the Medical Council of India, is factually incorrect. He would further submit that a similarly placed person's degree in MRCPCH was registered by the Tamil Nadu Medical Council. In this regard, the learned counsel for the petitioner has produced a copy of the registration certificate of one Dr. Nisha before this Court.

The learned Standing Counsel appearing for the first respondent would invite the attention of this Court to Section 12 of the Indian Medical Council Act, 1956, which deals with reciprocity between two countries, and would submit that if a degree from India is recognized in the United Kingdom, then, by invoking Section 12 of the Act as reciprocity, the Medical 3/6
Council of India would recognize the degree granted by the Royal College of Paediatrics and Child Health in MRCPCH. Therefore, the rejection order, which refers to the non-recognition by the Medical Council of India, is factually incorrect. She would also submit that an e-mail communication from the National Medical Commission confirms the recognition of the MRCPCH degree by the Medical Council of India.
5. At this juncture, the learned counsel appearing for the second respondent would fairly submit that when the Medical Council of India recognizes the degree of the petitioner, then they absolutely do not have any grievance in registering the same.
6. In view of the above factual position, the impugned order dated 21.11.2022 is hereby quashed. The second respondent is directed to register the petitioner's MRCPCH degree obtained by him from the Royal College of Paediatrics and Child Health upon production of the original certificate for verification, and upon such production, the second respondent is directed to register the same within a period of two weeks from the date of receipt of a copy of this order.
