ORDER
The petitioner, who was arrested and remanded to judicial custody on 18.08.2024 in S.C.No.425 of 2024 on the file of the Learned Principal Sessions Judge, Chennai, for the offences punishable under Sections 191(2), 191(3), 118(1) r/s 103(1), 109, 190, 351(3) R/w 61(2), 49 and 238 of BNS and Sections 4(b) r/w 5, 6 of Explosive Substance Act, 1908 and Sections 3 r/w 25(1B)(a) of Arms Act in Crime No.293 of 2024, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on account of previous enmity, the petitioner/ A15, who is the wife of one Arcot Suresh conspired with other accused to murder one Armstrong, who is the President of one of the state political party; that further the petitioner funded the accused by giving a 10 sovereigns of gold bracelet, which was pledged for raising fund for the purpose of procuring vehicles and for accommodation for the persons involved in the conspiracy to murder Armstrong; that thereafter on 18.08.2023, the accused persons (A4 to A9, A13 and A14) went to the house construction site of the Armstrong, brutally attacked him using various weapons and murdered him. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and she is in judicial custody since 18.08.2024 i.e., nearly 14 months. He further submitted that the final report also filed in this case, the prosecution has cited nearly 234 witnesses and 1000 of documents and same to be examined during the trial; that since there is no possibility of concluding the trial at the early point of time, even if the trial is proceeded on day to day basis. He further submitted that the petitioner being a lady, she has also undergone by-pass surgery seven years ago and further the petitioner is ready to abide by any conditions that may be imposed by this Court, sought for bail to the petitioner.

The learned Special Public Prosecutor appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that there are totally 30 accused and the petitioner herein is arrayed as A15. He further submitted that, it is the case of murder of a political leader of one of the state political parties, which created havoc in the state of Tamil Nadu. He also submitted that the petitioner herein is the wife of late Arcot Suresh, who believed that the deceased in this case has instigated the murder of 3/6
her husband, thereby conspired with other accused and funded them by providing 10 sovereigns bracelet, which was pledged for a sum of Rs.3.46 lakhs by other accused, created cloud fund and committed murder of Armstrong. Accordingly, three gangs participated in conspiracy and murder. He further submitted that the case is pending at the stage of framing of charges and all the accused are still in judicial custody.

I have considered the submissions made on both sides and perused the materials available on record.

Though the learned counsel for the petitioner submits that the petitioner is a heart patient and the medical certificate issued by the Medical Officer, Special Prison for Women, Chennai handed by the learned counsel for the petitioner, shows that the petitioner has undergone heart by-pass surgery seven years ago and she is presently stable with normal vitals. 7.
The facts and circumstances of this case reveals grave nature of offence, the overt act against this petitioner seems that, she had initiated the conspiracy to commit murder of the deceased by handing over jewels all 4/6
arrested accused are in custody. The case is at the stage of framing charges, taking note of the fact that so far, no accused were released in this case and grant of bail to the petitioner at this stage will hamper the trial proceedings, this Court is not inclined to grant bail to the petitioner. 8.
