ORDER

This Writ Petition has been filed by the petitioner seeking for a Writ of Mandamus, to direct the 1st respondent to consider the petitioner's representation dated 18.07.2025 and direct the 3rd respondent not to discriminate and preventing the 18 Dalit auto & auto drivers from carrying the patients Mahatma Gandhi Medical College Hospital, Bahour Comune, Puducherry - 607 402 to secure ends of justice.

2. Since no adverse has been passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.

3. Mr.M.Nirmal Kumar, learned Government Advocate, accepts notice on behalf of the respondents 1 and 2. In view of the consent expressed by the parties, this writ petition is taken up for final disposal at the stage of admission itself.

The case of the petitioner is that the 3rd respondent is preventing the auto rickshaw of 18 Adidravidat drivers of Pillayakuppam from taking the patient from bus stand to Mahatma Gandhi Hospital, Pillayarkuppam, Puducherry. Hence, against the said discrimination and untouchability, the petitioner has made a representation dated 18.07.2025 before the 1st respondent to resolve the dispute and to eradicate the untouchability openly practiced by the 3rd respondent, which is a criminal offence under SC & ST Prevention of Attrocities Act. Since the same was not considered, the petitioner has filed this writ petition before this Court for appropriate orders.

Though very many grounds have been raised in this writ petition, learned counsel appearing for the petitioner submits that, it would suffice, if this Court issues a direction to the 1st respondent to consider and dispose of the petitioner's representation, dated 18.07.2025, within a time frame that may be fixed by this Court. In view of the limited request sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the 1st respondent to consider the petitioner's representation dated 18.07.2025, on merits and in accordance with law and pass appropriate orders, within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioner and aggrieved persons, if any.

7. With the above direction, this Writ Petition is disposed of. No costs.
