ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case in Cr.No.1 of 2016 is an occurrence of the year 2016. The allegation in this case is that all the accused killed wildlife. It is stated that the accused belongs to Scheduled Tribe Community and are residing nearby the forest. In respect of three of the accused, there is one previous case and others do not have any bad antecedents. The case is pending from the year 2016, on the pretext that one after the other accused are absent and subsequently, warrant is also pending. The background of the parties is also taken into account. Considering the overall facts and circumstances of the case, the social background of the parties, the fact that they are not involved in the offences in recent times and some of the accused being the first time offenders, I am of the view that one opportunity can be given to these accused and also in view of efflux of time, no meaningful trial is possible. 4.

Accordingly, the case in C.C.No.600308 of 2018 of Judicial Magistrate No.2, Bhavani Taluk, Erode is quashed and this Suo Motu Transfer Case is disposed of.

10.10.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
