ORDER

This Criminal Original Petition has been filed to direct the respondent police not to harass the petitioner herein under the guise of investigation pertaining to the complaint pending on the file of the respondent.

2. The learned Additional Public Prosecutor has submitted that based on the complaint lodged by one Ramasamy CSR.No.236/19 was issued and only for enquiry purpose, the petitioner was called and he was not subjected to any harassment.

3. If the complaint discloses any cognizable offence, the respondent has to register the case and in case the said complaint does not discloses any cognizable offence, the respondent can conduct preliminary enquiry only with the Complainant and thereafter if the said enquiry discloses any cognizable offence, he has to register the case and proceed in 1/2 https://hcservices.ecourts.gov.in/hcservices/

accordance with law. Instead of that he should not call the petitioner before registering the FIR.

4.With the aforesaid directions, this Criminal Original Petition is disposed of.
