ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case in Cr.No.01 of 2015 is an occurrence of the year 2015. The allegation in this case is that, the accused ventured into the forest and illegally cut teak wood trees. Apart from that, they were found to be in possession of country made guns. It is submitted that in respect of two accused, there are no previous or subsequent case and in respect of one accused, there is one previous case.

Considering the background of the accused and the fact that they have been facing the trial from the year 2015 and they were not indulged in any such crime in the recent past, I am of the view that one opportunity can be given to all these accused. Further as the trial is half way through, considering the efflux of time, no meaningful trial is possible. 4.

Accordingly, the proceedings in C.C.No.600418 of 2018 on the file of Judicial Magistrate No.2, Bhavani Taluk, Erode is quashed and this Suo Motu Transfer Case is disposed of.

10.10.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
