Even before the writ petition could be admitted, it came to be dismissed for default as the counsel for the petitioner suffered a heart attack and could not appear before this Court. Since the counsel for the petitioner took ill, the party collected the bundle only after some time and therefore, the restoration petition could not be filed in time. Hence, the above W.M.P. has been filed to condone the delay of 243 days in filing the restoration application.

The writ petition came to be dismissed for default even before admission. Therefore, it is appropriate to condone the delay of 243 days in filing the restoration application.
