O R D E R

The petitioner, who apprehends arrest for the alleged offences punishable under Section 303(2) of BNS Act, 2023, (Corresponding Section 379 of IPC) on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other 1/6

accused is alleged to have involved in the theft of 3 goats. Hence the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that based on the confession statement of A2, this petitioner is arrayed as an accused. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that there are totally two accused in this case and the petitioner along with A2 had involved in the theft of three goats of the defacto complainant. He further submitted that out of three goats, two goats have been recovered from the accused and there are 13 previous cases pending against this petitioner, out of which, five cases are similar in nature. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on 2/6

record.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and also taking note of the fact that two goats have been recovered from the petitioner and the petitioner is ready to abide by any condition imposed of this court, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

7. Accordingly, the petitioner is ordered to be released on bail on his executing a separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Tiruvannamalai and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall deposit a cost of Rs.20,000/- (Rupees Twenty Thousand only) to the credit of Cr.No.227 of 2025 before the concerned Magistrate, within a period of two weeks from the date of receipt of a copy of this order. On such deposit, the defacto 3/6

complainant is permitted to withdraw the same on filing undertaking affidavit and proper identification and acknowledgment.

[c] The petitioner shall report before the respondent Police on every Tuesday and Saturday at 10.30 a.m., for a period of twelve weeks and thereafter, as and when required for interrogation ;

[d] the petitioner shall not abscond either during investigation or trial;

[e] the petitioner shall not tamper with evidence or witness either during investigation or trial; [f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[g] If the accused thereafter abscond, a fresh FIR can be registered under Section 229A IPC.
