ORDER
This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025. 2.This case was registered in Cr.No.86 of 2017 for the alleged offences under Sections 294 (b), 353 and 506 (1) of I.P.C. r/w Section 4 (1) (j) of TN Prohibition Act. The incident was occurred on 26.06.2017. The allegation in Page No.1 of 3
this case is that there was an altercation inside the Police Station and the accused abused the Police personnel in filthy language and threatened with dire consequences. For the said allegation the matter has been pending from the year 2017. It is reported that there is no previous or subsequent case against the accused.
3.Considering the nature of allegations, the antecedents of the accused, any further continuation of the proceedings will impinge upon the his right to a speedy trial and no useful purpose would be served by keeping the matter pending.
4.Accordingly, the case in C.C.No.153 of 2017 of District Munsif Cum Judicial Magistrate Court, Thirukalukundram Taluk, Chengalpattu, stands quashed. This Suo Motu Transfer Case is disposed of. 23.09.2025 ep electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. Page No.2 of 3
