PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the third respondent police officials not to harass the petitioner in connection with civil dispute for execution of settlement deed for the joint title property owned by the petitioner's husband late R.Krishna Kumar and others.

O R D E R

This petition has been filed to direct the third respondent police officials not to harass the petitioner in connection with civil dispute for execution of settlement deed for the joint title property owned by the petitioner's husband late R.Krishna Kumar and others.

2. The learned counsel for the petitioners has submitted that already based on the complaint lodged by the first petitioner, a case was registered in Crime No. 122 of 2019 under Sections 465, 468, 471 and 34 of IPC and the said FIR is pending before the CCB-II for investigation. He further submitted that now, one of the accused viz., V.S.Babu in Crime No.122 of 2019 has lodged a complaint against the petitioners before the third respondent and based on the said complaint, the third respondent is harassing the petitioners.

3. The learned Government Advocate has submitted that since one V.S.Babu has lodged a complaint against the petitioners herein before the third respondent, petitioners have been called for enquiry by the third respondent and they were not to subjected to any harassment.

4. Since already one FIR is pending before the CCB-II, Chennai, the third respondent is directed to forward the complaint of V.S.Babu to the CCB-II, Chennai. It is for the CCBII, Chennai to enquire the said complaint and proceed in accordance with law.

5. With the above said directions, this Criminal Original Petition is disposed of.
