No.e4 (2) / 187/ 78857/ 2022 dated 01.06.2023 and quash the same and further direct the 1st respondent to give no objection certificate, to the petitioner to run a SPA. ORDER

The petitioner herein who is keen in providing SPA and Massage Parlour services to the public, had sought for permission from the first respondent and after considering the representation seeking permission to run SPA and Massage Parlour under the name and style of "Lets Relaxation Massage Centre", the Director General of Police/Commissioner of Police, Greater Chennai, had declined to give NOC on the ground that the petitioner does not satisfy the necessary requirements mandated under the Regulation No.SRO-C-2-2019 issued under Section 373 of Chennai City Municipal Corporation Act, 1919.

Particularly, the impugned order states that the Applicant does not possess required qualification and the masseur/masseuse do not possess required qualification, further it is also found that there is no adequate parking facility in the SPA premises and therefore, there is 'Objection' from the Police point of view for grant of trade license to the SPA.

Considering the reasons given in the impugned order indicate that the petitioner does not comply the health measures and the parking facility, this Court does not find any illegality in the impugned order which requires interference, hence, this Petition is dismissed. Consequently connected Miscellaneous Petition is also dismissed. No costs.
