C.M.P.No.3124 of 2023 in C.R.P.No.2019 of 2016 G.K.ILANTHIRAIYAN, J.

This petition is filed to condone the delay of 146 days in filing the petition to set aside the order of dismissal in C.R.P.(NPD).No.2019 of 2016 for non-prosecution dated 30.06.2022.

2. The learned counsel for the petitioner would submit that the Managing Trustee of the temple died and as such the subsequent Managing Trustee could not able to follow the case.

Therefore, the petitioner could not able to instruct his counsel properly.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 146 days is condoned and the petition is ordered.
