Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Certiorari, To call for the records in connection with impugned orders passed by the first respondent in his 1/4
proceeding bearing in sey. Mu. Aa. No. 5757/ U/ 2021 dated 07.07.2022, complaint fled by the 3rd respondent and quash the same. For Petitioner : M/s.P.M.Jayachandran For Respondents : M/s.Shahjahan, Spl.GP, for R.1 and R.2.
O R D E R
The Writ Petition is filed to quash the impugned order dated 07.07.2022 passed by the 1st respondent, in sey. Mu. Aa. No. 5757/ U/ 2021.
2. Aggrieved by the order of the 1st respondent dated 07.07.2022 cancelling the partition deed in Document No.1737/2016, on the basis of Section 77-A of the Registration Act, the petitioner is before this Court.
3. In the light of the Judgement passed by the Division Bench of this Court in M.Kathirvel Vs. Inspector General of Registration - 2024 (4) CTC 769, the order passed by the 1st respondent cancelling the above said documents cannot be sustained.
4. Accordingly, the Writ Petition is allowed. The impugned order is 2/4
quashed. No costs. Consequently, the connected Miscellaneous Petition is closed.
