This petition is filed to condone the delay of 423 days in filing the above second appeal in the above appeal in S.A.SR.No.151970 of 2023.

3. The learned counsel for the respondents have raised formal objection for allowing the petition. The matter is pending from the year 2012.

4. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the petitioner is aged about 76 years put an end to the litigant, this petition is ordered and delay of 423 days in filing the above appeal is condoned on payment of cost of Rs.3000/- (Rupees Three Thousand only) to the counsel who is contesting the respondents, on or before 08.01.2025.

5. Registry is directed to number the above second appeal, if it is otherwise in order and post the second appeal on 08.01.2024.
