ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in C.C.No.27 of 2018 was taken on the file of the Judicial Magistrate I, Salem Taluk, Salem, for the alleged offence under Sections 379 of I.P.C. The occurrence is said to have taken place on 01.07.2014. The accused committed theft of defacto-complainant's car. It is reported that the property involved in this case has been recovered and handed over to the defacto-complainant. The defacto-complainant does not want to pursue the case any further. It is reported that the accused has been attending the Court regularly. There is no previous or subsequent previous case against the accused.

3.Considering the nature of the allegation, the antecedents of the accused and since the accused has been facing the case since 2018, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served. 4.Accordingly, the case in C.C.No.27 of 2018 of Judicial Magistrate I, Salem Taluk, Salem, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
