The petitioner seeks bail in Crime No.156 of 2023, registered by the respondent police for the offences punishable under Section 6 of POCSO Act, 2012. The petitioner had been taken into custody on 14.10.2023. 2.The learned counsel for the petitioner stated that there has been no contact between the petitioner and the victim child for more than one year and after more than one year the complaint has been given. However, it is the case of the prosecution that the incident which is complained of happened on 08.10.2023.
3.It is also stated that the statement under Section 164(5) Cr.P.C., of the victim child had also been recorded and investigation has been completed and charge sheet would be filed.
4.Let the victim child be examined and cross-examined, and thereafter, the application for bail can be considered. At this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
