2. When the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that this Court granted interim anticipatory bail to the petitioner till 09.01.2022 and directed the petitioner to deposit a sum of Rs.10,00,000/- to the credit of Crime No.706 of 2022 before the learned Judicial Magistrate, Madhukarai within four weeks from the date of receipt of a copy of the order and he further submitted that the petitioner is unable to mobilse the fund Rs.5,00,000/- now he is ready to deposit a title deed stands in the name of his father worth about Rs.10,00,000/- but on seeing the fact that the intervenor raised objection stating that nearly about Rs.50,00,000/- was lost due to the conduct of this petitioner.

3.Considering this submission, this Court is inclined to modify the condition to the effect that the petitioner shall deposit a sum Rs.5,00,000/- https://www.mhc.tn.gov.in/judis

vsn to the credit of Crime No.706 of 2022 along with the title deed standing in the name of his father within four weeks from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Madhukarai, as agreed before this Court and along with an undertaking affidavit of the owner of the property that he would not alleniate the property till the disposal of the proceeding, on such deposit the defacto complainant is permitted to withdraw the deposit amount of Rs.5,00,000/, on filing undertaking affidavit and proper acknowledgement.

4.In view of the above, this Court is inclined to grant anticipatory bail to the petitioner. The other conditions imposed by this Court on 09.01.2023 shall remain intact.
