Respondent PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Certirarified Mandamus, calling for the records pertaining to the proceedings of the respondent in f/vz;/ c/ br /bgh-,/eh/kzyp / kpd; ,izg;g[ vz;/016-071-332-vz; Camp dated 22.12.2022, resulting in the notice dated 22.12.2022 and the order dated 22.12.2022 made therein and quash the same and consequently directing the respondent to restore the electricity supply under Account No.016-071-332, TF-III B, to the premises bearing No.32, Basin Road, Thulasiram Nagar, Thiruvotriyur, Chennai-600 019 and to forebear the respondent from insisting on paying a sum of Rs.1,76,798/- as mentioned therein.

O R D E R
This writ petition has been filed, challenging the impugned notice and order dated 22.12.2022, and consequently directing the respondent to restore the electricity supply under Account No.016-071-332, TF-III B, to the premises of the petitioner and to forebear the respondent from insisting on paying a sum of Rs.1,76,798/- as mentioned therein.

The case of the petitioner is that the petitioner is the sole and absolute owner of the property situated at No.32, Basin Road, Thulasiram Nagar, Thiruvotriyur, Chennai-600 019, wherein he has located his factory and carrying on fabrication work. The petitioner has obtained industrial electricity supply from TANGEDCO bearing account No.016-071-332, TF-III B, and he has been enjoying the uninterrupted industrial electricity supply from TANGEDCO for the last 10 years. On 22.12.2022, at about 12.30 p.m, the respondent accompanied by some members of the staff of his office had visited the petitioner's premises and arrived a conclusion that as if the petitioner supplied electricity connection to 11 other shops which are owned by him and thereby, the respondent disconnected the electricity supply to the petitioner's premises and passed the impugned notice and order dated 22.12.2022 directing the petitioner to pay a sum of Rs.1,76,798/- within a period of 15 days there from. Challenging the same, the present writ petition is filed.

Heard the learned counsel on either side and perused the records. 4.The learned counsel for the petitioner would submit that during the pendency of the writ petition, this Court passed an interim order dated 28.12.2022, directing the petitioner to deposit 50% of the amount and restore the electricity connection in favour of the petitioner. In view of the interim order, the petitioner had continuously effected service connection to 11 other rented shops, without obtaining separate connection as per the distribution rule. However, this Court may permit the petitioner to pay the remaining 50% of the demand, within a period of two weeks from the date of receipt of a copy of this order and permit the petitioner to make a fresh application before the respondent in respect of 11 other rented shops individually and the respondent may be directed to collect the penalties without collecting BPSC and interest charges from the petitioner and effect the service connection in favour of the petitioner.

The learned standing counsel for the respondent would submit that the petitioner's representation will be considered by imposing necessary penalties in respect of 11 rented shops in which the service connection was effected by the petitioner illegally and continued the service connection on the basis of the
interim order passed by this Court.

In view of the above submissions, this Court is inclined to dispose of the writ petition with the following directions: i) The petitioner is directed to deposit the remaining 50% of the demand within a period of two weeks from the date of receipt of a copy of this order. ii) The petitioner is granted liberty to file a fresh electricity connection application for 11 individual shops and on receipt of such applications, the respondent shall consider the same, after collecting necessary penalties, without collecting BPSC and interest charges and dispose of the individual applications within a period of four weeks, thereafter.
