O R D E R

The petitioner herein was arrested on 09.07.2025 for the alleged offence punishable under Sections 316(2), 318(4), 319(2), 336(2), 336(3), 1/5

338 of BNS and Section 66D of IT Act, 2000 in Crime No.27 of 2025 on the file of the respondent, seeks bail.

2.The allegation against this petitioner is that, this petitioner joining hands with some other accused under the pretext of running an online trading business had cheated the defacto complainant and others to a tune of Rs.22,30,74,368/- by using the mobile app namely, ICICI Securities and they collected money from various accounts between 25.02.2025 and 17.04.2025. Subsequently, the defacto complainant came to know that this company is a bogus online company and based on his complaint, the present FIR was registered. So far totally four accused persons were arrested. This petitioner is arrayed as A3.

3.The learned counsel for the petitioner submitted that this petitioner is only an employee under the other accused persons and he has not collected any money and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any condition imposed by this Court.

4.The learned Government Advocate (Crl. Side) appearing for the respondent reported that so far five accused were identified in this case and four of them were arrested. Since the transactions were taken place in different bank accounts, the investigation is going on. The specific overtact against this petitioner is that he alone collected a sum of Rs.20,00,000/- through his account from various persons. Hence, he opposed to grant bail to the petitioner.

5.Considering the fact that the total amount involved in this case is huge and it also revealed that the petitioner has received a sum of Rs.20,00,000/- through his account and so far no money is recovered and though the petitioner is in custody for a long period, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
