ORDER
The petitioner, who was arrested and remanded to judicial custody on 23.07.2025 for the alleged offence under Sections 140(2), 127(2), 118(1) and 351(1) of BNS, 2023, in Crime No.225 of 2025, on the file of respondent police, seeks bail.

The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, as if he, along with other accused, had kidnapped the defacto complainant and demanded a ransom of Rs.15 lakhs, and out of which Rs.13 lakhs were allegedly paid, after which the complainant was released. He further submitted that the petitioner was not present at the time of the alleged incident and that he is a B.Tec.student of Hindustan College of Engineering and Tech., Coimbatore, Hence, he seeks, for grant of bail to the petitioner.
3. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that there are totally 7 accused, and the petitioner is
arrayed a A6. It is alleged that he kidnapped the defacto complainant, demanded a sum of Rs.15 lakhs, and also received Rs.13,50,000/-. As of now, the said amount has been recovered. Except for A4 and A6, the other accused are obsconding. The defacto complainant is also a history sheeter as per the FIR allegations. He further submitted that there is no previous case pending against the petitioner has also produced the ID card. The investigation is almost completed. However, he opposed to grant bail to the petitioner.

Taking into consideration the facts and submissions made by both counsels, the investigation is almost completed and he is a college student and also considering the period of incarceration undergone by the petitioner, this court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, in which one surety must be a Parent surety for a like sum to the satisfaction of the learned District Munsiff- cum - Judicial Magistrate, Annur, and on
further conditions that:
(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b) the petitioner shall report before the respondent police daily at 6.00 p.m. for the period of three months. (c) the petitioner shall not tamper with evidence or witness either during investigation or trial;
(d) the petitioner shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
