O R D E R

The Criminal Original Petition has been filed for directing the respondents not to harass the petitioner and its staff from running of the restaurant business along with serving of herbal hookah under the name and style of M/s.FUKREY.

2. The petitioner, who has already came to adverse notice of the police for violating the Child Abuse Prevention and Treatment Act for four times, now under the garb of serving herbal hookah, seeks direction from this Court, prohibiting the respondent police from restraining the petitioner from running herbal hookah. It is a clear case where the petitioner is seeking a protective order from the High Court for running illegal trade. Court cannot be a party to such illegality. On perusal of the records submitted by the petitioner, this Court finds that by filing a similar petition and misleading the Court, the petitioner has obtained protective order, which ought not to have passed, without ascertaining the credentials of the petitioner. Unfortunately, some of the Hon'ble Judges of this Court, without considering the consequences, pass such order, which is very painful.
