Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the second respondent herein to close the recognition and approval to run the Vivekanandha Vidhyalaya Nursery and Primary School, Uthangarai, Krishnagiri District by considering the representation of Tmt.Prema Sarojini dated 24.08.2024.
For Petitioner : Mr.R.Nalliyappan 1/6
For Respondents For R1 & 2 : Mr.S.Prabakaran, Government Advocate
O R D E R
This writ petition has been filed for direction to the second respondent to close the recognition and approval to run Vivekanandha Vidhyalaya Nursery and Primary School, Uthangarai, Krishnagiri. 2.
Heard, the learned counsel appearing for the petitioner, the learned Government Advocate appearing for respondents 1 & 2 and perused the materials available on record.
3.
On perusal of records, it is revealed that one, Dhandapani and K.Ramachandran established the educational trust in the name and style of Vivekanandha Educational Trust on 27.06.2011. It started a school in the name of Vivekanandha Vidhyalaya Nursery and Primary School, Uthangarai. After demise of the said Dhandapani, his wife Prema Sarojini was inducted as trustee. Thereafter, the said Ramachandran also died on 03.12.2023 and the petitioner was inducted as trustee. Though 2/6
the third respondent has no locus to take over the administration of the trust, she, claiming to be the trustee of the school, filed writ petition before this Court in WP.No.118 of 2025 seeking permission to operate the bank account of the school on the ground that on the demise of her husband Ramachandran, she had taken over the trusteeship. Thereafter, the third respondent collected huge amount of donations from the general public for admission and spoiled the reputation of the school. Therefore, the petitioner submitted representation to take action to close the recognition of the said school.
4.
It is seen that there is a dispute between the petitioner and the third respondent in respect of their trusteeship. If at all the aforesaid school i.e. Vivekanandha Vidhyalaya Nursery and Primary School has failed to follow any of the procedures, the officials concerned will look after the non compliance. By way of representation submitted by the petitioner, no action can be taken against the school since it is the dispute between the petitioner and the third respondent with regards to their trusteeship.
5.
In view of the above, this writ petition is liable to be 3/6
dismissed. Accordingly, this writ petition is dismissed. There shall be no order as to costs.
