This petition is filed to condone the delay of 364 days in filing the writ appeal.
Heard Ms.N.Devi, learned counsel for the petitioners and Mr.M.Sivaraman, learned counsel for the first respondent.
Though the reasons having been adused in the affidavit filed in support of this petition, that has been stoutly denied and this petition is opposed by the learned counsel appearing for the first respondent, having regard to the facts and circumstances of this case, we are inclined to allow this petition on a condition of payment of a sum of Rs.2,000/- by the petitioners to the first respondent through their counsel within two weeks, failing which, this petition shall automatically stand dismissed without any further reference to this Court.
The petition, accordingly, stands ordered on compliance of the aforementioned condition.
